1. Overview
Akera LLC respects the intellectual property rights of others and expects users of Akera to do the same. We will respond to notices of alleged copyright infringement that comply with the DMCA (17 U.S.C. § 512).
Note: Akera is primarily a private mail service. We do not host public content, so DMCA notices about mail in transit are usually misdirected. The correct recipient is the sender or the platform that originally hosted the content. We will still review good-faith notices and take appropriate action where Akera is hosting infringing material.
2. Designated agent
You can reach our designated DMCA agent at:
- Email: dmca@akera.tech
- Postal mail: Akera LLC, DMCA Agent, California, United States. Email is strongly preferred so we can respond promptly.
3. Filing a takedown notice
A valid DMCA notice must include all of the following:
- A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
- Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works are involved).
- Identification of the material that is claimed to be infringing, with enough detail to let us locate it on the Service.
- Your contact information (name, address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Incomplete notices may delay or prevent processing. Please send notices to dmca@akera.tech.
4. Counter-notification
If you believe your content was removed in error, you can submit a counter-notification including:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which you reside (or, if outside the United States, any judicial district in which Akera may be found), and that you will accept service of process from the person who sent the original notice.
Send counter-notifications to dmca@akera.tech. If we receive a valid counter-notification, we may restore the removed material in 10–14 business days unless we receive notice that the original complainant has filed an action seeking a court order.
5. Repeat infringers
Akera will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
6. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be liable for damages. Please do not file frivolous or abusive DMCA notices.
