1. Acceptance of Terms
These Terms of Service (“Terms”) are a legal agreement between you and Akera LLC, a California limited liability company (“Akera,” “we,” “our,” or “us”). They govern your use of the Akera web app, desktop client (Windows and Linux), related sites, and APIs (the “Service”). By creating an account or otherwise using the Service, you agree to these Terms and our Privacy Policy and Acceptable Use Policy.
2. The Service
Akera is a mail, calendar, and contacts service. Features available today include mail sending and receiving, drafts, signatures, contacts, native calendar with ICS invite support, folders and labels, themed UI, server-side search, workflows and automations, optional Telegram alerts, and desktop clients for Windows and Linux. Specific features may change as the product evolves.
3. Beta status
Akera is currently offered as a public beta. This means:
- The Service is provided on an “as is” and “as available” basis with no uptime or service-level commitments.
- Features may be added, removed, or significantly changed.
- Data limits, attachment limits, and per-plan quotas are governed by your chosen plan. We will provide reasonable advance notice of any material change to these limits.
- You should maintain your own backups of any data you cannot afford to lose.
4. Eligibility & accounts
- You must be at least 13 years old to use the Service. Users between 13 and the age of majority in their jurisdiction must have permission from a parent or legal guardian.
- You are responsible for the accuracy of the information you provide and for safeguarding your credentials.
- You are responsible for all activity that occurs under your account.
- One person or legal entity may maintain multiple accounts, subject to the Acceptable Use Policy.
5. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy. In particular, you may not use the Service to send unsolicited bulk email, distribute malware, conduct phishing, violate applicable laws, or infringe the rights of others. We may suspend or terminate accounts that violate the AUP.
6. Billing, subscriptions & refunds
- Paid plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor. By selecting a paid plan you authorize Akera (via the processor) to charge your payment method on a recurring basis until you cancel.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before renewal.
- Cancellation. You can cancel at any time from the subscription portal. Cancellation takes effect at the end of the current billing period; you retain access until then.
- Refunds. See our Refund Policy. We generally do not provide pro-rated refunds for partial billing periods, except where required by law.
- Price changes. We may change prices for future billing periods. We will give reasonable advance notice; continued use after the change takes effect constitutes acceptance.
- Taxes. Prices are exclusive of applicable taxes, which may be added at checkout based on your billing address.
7. Cancellation & suspension
You may stop using the Service at any time. To delete your account, use Settings → Security in the app or follow the instructions on the Account Deletion page (or write to privacy@akera.tech). We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, the Acceptable Use Policy, applicable law, or to protect the integrity, security, or operation of the Service. Where reasonable and lawful, we will provide notice before suspension.
8. Your content
You retain ownership of the content you send, receive, or store through the Service (“Your Content”). You grant Akera a limited, non-exclusive, worldwide, royalty-free licence to host, copy, transmit, display, and process Your Content solely as necessary to operate and provide the Service to you. This licence ends when Your Content is deleted from the Service.
You represent that you have the rights necessary to use, send, and store Your Content through the Service, and that doing so does not violate applicable law or the rights of any third party.
9. Our intellectual property
Akera, AkeraMail (our former product name), our logos, website, and Service (including software and documentation) are owned by Akera LLC and protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. All rights not expressly granted are reserved.
10. Third-party services
The Service relies on sub-processors and integrates with third-party services (including Amazon Web Services, Stripe, Netlify, Cloudflare, and, optionally, Telegram). Use of those third-party services is governed by their own terms and privacy policies. See our Subprocessors page for the current list.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Akera disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, timely, secure, or that defects will be corrected.
12. Limitation of liability
To the maximum extent permitted by law, in no event will Akera, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Our aggregate liability for direct damages will not exceed the greater of (i) the amount you paid us for the Service in the twelve months immediately preceding the event giving rise to liability, or (ii) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you in full.
13. Indemnification
You agree to defend, indemnify, and hold harmless Akera and its affiliates, and their respective officers, directors, employees, and agents, from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third-party right.
14. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The exclusive jurisdiction and venue for any dispute relating to these Terms or the Service will be the state and federal courts located in California, and you and Akera consent to personal jurisdiction there. You and Akera waive any right to a jury trial in any such dispute, to the maximum extent permitted by law. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will provide notice through the Service or by email to the address associated with your account. The “Last updated” date at the top of this page always reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance.
